DUI Facts

DUIs are one of the most common offenses committed in Southern California. Many people are not aware that there are generally two ways to get arrested for a DUI in California. The first is a violation of Vehicle Code section 23152(a), which states that it is unlawful for any person who is under the influence of any alcoholic beverage or drug, or their combined influence, to drive a motor vehicle. This means that if, in the opinion of the arresting officer, you cannot operate a motor vehicle with the caution and care of an ordinary person acting under similar circumstances, you can be arrested for a DUI. As you can see, this is a very subjective code section, leaving much room for a challenge in court by an effective dui attorney.
The other most common way to get arrested is for a violation of Vehicle Code section 23152(b), which states that it is unlawful for any person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a motor vehicle. Though this is set number, the prosecution must be able to show that your blood alcohol level was at least a 0.08 at the time of driving. If your blood alcohol test was performed some time after you were pulled over by the police, the prosecution might have a difficult time proving that you were over the legal limit at the time of driving.
